Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Emercive Marketing LLC, an Arizona limited liability company doing business as CrewPush (“CrewPush,” “we,” “us,” or “our”). By creating an account or using the CrewPush website or application (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

CrewPush is a social-media and lead-generation platform that helps construction and trade businesses create, schedule, and publish content to connected social accounts, and manage related marketing activity. We may add, change, or remove features at any time.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for keeping your password secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3. Free trial, subscriptions, and billing

  • Free trial. New subscriptions include a 14-day free trial. A valid payment method is required to start the trial. If you do not cancel before the trial ends, your paid subscription begins automatically and your payment method is charged.
  • Plans. Paid plans (such as Foreman, Crew, and Contractor Pro) are billed in advance on a recurring monthly or annual basis at the rates shown at checkout.
  • Renewal. Subscriptions renew automatically for successive periods until cancelled. You authorize us and our payment processor to charge your payment method for each renewal.
  • Cancellation. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period, and you retain access until then.
  • Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods.
  • Price changes. We may change prices with reasonable advance notice; changes apply to the next billing period after the notice.
  • Taxes. Stated prices do not include taxes, which you are responsible for where applicable.

4. Acceptable use

You agree not to use the Service to:

  • Violate any law or the terms or policies of any connected social-media platform;
  • Post content that is unlawful, infringing, deceptive, harassing, hateful, or otherwise harmful;
  • Infringe the intellectual-property or privacy rights of others;
  • Transmit malware, spam, or engage in fraudulent or abusive activity; or
  • Interfere with, disrupt, reverse-engineer, or attempt to gain unauthorized access to the Service.

5. Your content and connected accounts

You retain ownership of the content you provide. You grant CrewPush a non-exclusive, worldwide license to host, process, adapt, and publish that content solely to operate the Service and to post on your behalf to the accounts you connect. You represent that you have all rights necessary to grant this license and to publish the content, and you are solely responsible for what is posted through your account. You authorize CrewPush to access and publish to your connected accounts on your behalf, and you remain bound by each platform’s terms.

6. AI-generated content

The Service uses artificial intelligence to help generate captions and post copy. AI output may contain errors or inaccuracies and is provided for your review. You are responsible for reviewing and approving all content before it is published and for ensuring it is accurate, lawful, and appropriate for your business.

7. Third-party platforms and services

The Service integrates with third-party platforms (including Google Business Profile, Facebook, Instagram, and LinkedIn) and providers (including Stripe and our AI and email vendors). Your use of those platforms is governed by their own terms, and we are not responsible for their availability, changes, or actions, including any suspension or restriction of your accounts by those platforms.

8. Intellectual property

The Service, including its software, design, and content (excluding your content), is owned by CrewPush and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY MARKETING RESULTS WILL BE ACHIEVED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREWPUSH AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless CrewPush and its owners from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Service, or your violation of these Terms or of any law or third-party rights.

12. Termination

You may stop using and cancel the Service at any time. We may suspend or terminate your access if you violate these Terms, fail to pay, or use the Service in a way that risks harm to us, other users, or third parties. Upon termination, your right to use the Service ends; sections that by their nature should survive will survive.

13. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona for any dispute not subject to other agreement.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
